Legal Framework and Regulations Organ and tissue donation and transplantation in India is regulated by National Organ and Tissue Transplant Organization (NOTTO) and it adheres to Transplantation of Human Organs and Tissues Act (THOTA). This legislation strictly prohibits any commercial dealings in human organs or tissues. Only immediate family members, such as spouses, children, parents, siblings, and grandparents, in India are eligible to donate organs to the respective foreign nationals. Additionally, the legislation has disclosed a few procedures for foreign donors that are as follows: 1.&nbsp;Authorization Committee Approval: Foreign individuals seeking organ or tissue transplantation in India must obtain prior approval from the authorization committee of the National Organ &amp; Tissue Transplant Organisation (NOTTO). 2.&nbsp;Embassy Certification: To confirm the relationship between the donor and recipient: Any higher official from either the donor's country's donor organization or the recipient country's donor organization must certify it. They must use Form 21 for this certification and authorization. 3.&nbsp;Registration Process: Foreign patients in need of organs from deceased donors can register through their treating hospital in India. Their inclusion in the waiting list registry is contingent upon no eligible Indian patients being available at that time nationwide. Awareness and Education Initiatives Knowing the critical need to inform and educate foreign nationals about these regulations, the Union Health Ministry has urged the ministries of home affairs and external affairs to disseminate information prominently. This includes displaying information at airports and on Bureau of Immigration's web portals to ensure increased awareness among incoming foreign patients. Increased Vigilance and Collaboration In April, the Union health ministry also directed state governments, union territories, and the ministry of external affairs to share details of foreign patients arriving in India for medical treatments, including organ transplants. Challenges and Moving Forward Despite these measures, challenges remain concerning the proper education of foreign patients by private hospitals before they arrive in India.
